Article 2.—LEGISLATIVE

§ 23.

History: Adopted by convention, July 29, 1859; ratified by electors, October 4, 1859; L. 1861, p. 54; eliminated by revision, L. 1974, ch. 458; November 5, 1974.

Revisor's Note:

Prior to 1974 revision, section prohibited making distinctions between rights of males and females in the formation and regulation of schools.

CASE ANNOTATIONS

1. Section does not apply to qualifications of electors for superintendent. Winans v. Williams, 5 Kan. 227, 228.

2. Establishment of separate schools for children of different races not authorized by law. Board of Education v. Tinnon, 26 Kan. 1, 22.

3. Section is a mandate to the Legislature to establish, encourage and maintain a system of public schools. Boshell v. Peterson, 142 Kan. 448, 452, 50 P.2d 941.
