CASE ANNOTATIONS

1. Presumption court has obtained legal and valid jury. The State v. Taylor, 36 Kan. 329, 332, 13 P. 550. Questioned: State v. Harris, 103 Kan. 347, 350, 175 P. 153.

2. Section not repealed by L. 1901, ch. 236 (see K.S.A. 43-123). The State v. Schmidt, 74 Kan. 627, 629, 87 P. 742.

3. Selection of jurors is properly a judicial function. Moore v. Nation, 80 Kan. 672, 677, 103 P. 107.

4. Regular array discharged; duty of judge to select another jury. The State v. Allen, 98 Kan. 778, 786, 160 P. 795.

5. Construed; under facts jurors properly selected by court hereunder. State v. Neff, 169 Kan. 116, 118, 132, 133, 218 P.2d 248.

6. Motion to quash jury panel sustained; new jury panel selected hereunder. State v. Hickock, 188 Kan. 473, 475, 363 P.2d 541.
