43-156. Same; right to serve as juror; qualification as elector. No person shall be excluded from service as a grand or petit juror in the district courts of Kansas on account of race, color, religion, sex, national origin, or economic status. Every juror, grand and petit, shall be a citizen of the state, resident of the county and possess the qualifications of an elector as now, or in the future established.

CASE ANNOTATIONS

1. Method used in selection of jurors conformed to statutory requirements and did not violate defendant's constitutional rights. State v. Campbell, 217 Kan. 756, 762, 539 P.2d 329.

2. Court may declare mistrial upon discovery of disqualified juror; doctrine of "manifest necessity" considered. State v. Folkerts, 229 Kan. 608, 610, 611, 629 P.2d 173 (1981).

3. Statutes relative to jury panels not violative of constitutional right to jury representing fair cross-section of community. State v. Baker, 249 Kan. 431, 436, 819 P.2d 1173 (1991).

4. Challenge to jury composition and failure to discharge jury panel examined. State v. Ji, 251 Kan. 3, 7, 832 P.2d 1176 (1992).

5. Use of voter registration lists as sole source for jury panels as neither statutorily or constitutionally impermissible discussed. State v. Bailey, 251 Kan. 156, 160, 834 P.2d 342 (1992).

6. Court must presume grand jury members were qualified; state is not obliged to establish qualification of grand jury members. State v. Snodgrass, 267 Kan. 185, 187, 196, 979 P.2d 664 (1999).

7. Statute prohibits excluding individuals from jury service on basis of socioeconomic status or race. State v. Lewis, 38 Kan. App. 2d 91, 94, 161 P.3d 807 (2007).
